Alabama lease agreements allow a landlord and tenant to enter into a legal contract to occupy a property in exchange for the payment of rent. The most common type of rental contract is the 12-month fixed lease which guarantees the property to the tenant for a period of one (1) year as long as the same monthly payments are made on time (typically on the first (1st) of the month).

Alabama Month-to-Month Rental Agreement

The Alabama month-to-month rental agreement allows a tenant to pay a monthly fee (“rent”) from a landlord for one month at a time with no end date. The landlord will collect a security deposit to ensure that rent will be paid and the responsibilities of the agreement are performed.

The agreement is only between the guests with the landlord being held harmless of any liability. The individual(s) listed as the tenant(s) on the original or master lease is the only person that will be held liable in any eviction action.

Alabama Commercial Lease Agreement 

The Alabama commercial lease agreement is for any tenant seeking to occupy retail, office, or industrial space for a business or personal use. The payments are typically made on a monthly basis and may range anywhere from one (1) to five (5) years and can be for any time-frame as desired by the parties. Renewal periods, option periods, first right of refusal, and options to purchase may be included in the agreement.

Alabama Security Deposit Laws

Maximum Amount ($) – One (1) month’s rent. Does not include a pet deposit (§ 35-9A-201(a)).

Returning – Sixty (60) days (§ 35-9A-201(e)). If not paid on time the landlord will owe the tenant double the amount (§ 35-9A-201(f)).

Alabama Required Disclosures

Lead-Based Paint Disclosure – Required for any property that was constructed prior to January 1, 1978.

Owner’s Information – The landlord must give the name and address of the person authorized to manage the premises (§ 35A-9A-202(a)).

Alabama Rent Grace Period

There is no grace period in Alabama. Rent is due on the date and place as described in the lease. If rent is paid after the day mentioned the landlord is able to charge a late fee (§ 35-9A-161(c)).

    I care for an 81 year old man who’s been made move from his residence he’s lived at since 2013 to present. The property was sold without any warning it was up for sale. He needs rental add with an apartment ASAP
